1. Introductory Provisions
These terms and conditions govern the rights and obligations of the seller and the buyer when purchasing personalized PDF crossword puzzles and bingo cards through the web application https://elisgrid.com.
The seller is:

a natural person doing business under a trade authorization, registered in the Trade Licence Register (živnostenský rejstřík)
with a place of business in the Czech Republic
(hereinafter referred to as the "seller" or "provider").
The buyer is a natural or legal person who orders and pays for a product through the web application elisgrid.com (hereinafter referred to as the "buyer" or "user").
These terms and conditions are governed by the law of the Czech Republic. If the buyer is a consumer whose habitual residence is in another country, this does not affect the mandatory consumer protection provisions of the law of that country.
2. Subject of the Service
The subject of the service is providing access to a digital product – a personalized PDF crossword puzzle – based on the data entered by the buyer. After payment, the buyer receives a link through which they can further customize the design of the crossword and download it in PDF format.
The content of the crossword (secret phrase, questions, and answers) cannot be changed after purchase. If the buyer discovers an error, they may contact the seller at info@elisgrid.com and the error will be corrected free of charge. Changes to the content on request (e.g., different questions) are not part of the service.
The same terms apply to personalized PDF bingo cards. After payment, the buyer receives a link through which they can customize the bingo card design for 7 days, save up to 3 versions, and download them in PDF format. The bingo squares cannot be changed after purchase; in case of an error, the buyer may contact the seller at info@elisgrid.com and the error will be corrected free of charge.
3. Delivery Conditions
The link for customizing the design and downloading the product is sent by email immediately after payment. The design of the product can be customized for 7 days from payment, and up to 3 versions can be saved during this period. Saved versions can still be downloaded in PDF format after this period has expired.
4. Price and Payment Terms
The price of the digital product is stated inclusive of VAT.
The ordering process and payments are handled by the online reseller Paddle.com, which acts as the merchant responsible for the sale (the Merchant of Record) for all orders. Paddle handles payments, invoicing, VAT, and international tax matters, and processes any refunds. In addition to these terms and conditions, the purchase is also subject to Paddle's buyer terms. The seller is responsible for creating and delivering the product and for its properties.
5. Right to Refuse an Order
The seller reserves the right to refuse any order without providing a reason, in particular in the event of suspected fraud or a breach of these terms and conditions. In such a case, the payment will be refunded in full.
6. Complaints and Withdrawal from the Contract
Due to the nature of the product (digital content customized to the buyer’s specifications), it is not possible to unilaterally withdraw from the contract pursuant to Section 1837(d) of Act No. 89/2012 Coll., the Czech Civil Code. If Paddle's buyer terms grant the consumer a right of withdrawal, the scope and expiry of that right are governed by those terms; in particular, the right is lost as soon as the buyer starts downloading or using the product after having agreed, when paying, to the product being made available before the end of the withdrawal period.
If the product has a defect (e.g., errors in the text or technical problems), the buyer may exercise their rights arising from defects (lack of conformity), i.e., lodge a complaint, by email at info@elisgrid.com. It is advisable to report the defect without undue delay after discovering it; a buyer who is a consumer may exercise their rights arising from defects within the statutory period (generally two years from delivery of the product).
The seller will remedy the defect free of charge. If this is not possible, if the seller fails to remedy the defect within a reasonable time, or if the defect is material, the buyer is entitled to a reasonable price reduction or may withdraw from the contract and request a refund of the price paid.

7. Liability
The seller is not liable for damage caused by technical problems beyond the seller’s control (e.g., server outages, loss of connection).
Nor is the seller liable for damage caused by improper use of the product by the buyer.
In relation to a buyer who is not a consumer, the amount of compensation for damage shall not exceed the amount paid for the specific order.
The provisions of this article and of Article 11 do not apply to the extent that the law does not permit liability to be limited or excluded, in particular for harm caused intentionally or through gross negligence, and they do not affect the buyer's rights arising from defects.
8. Copyright Protection
The purchased product is intended exclusively for the buyer's personal use. Any further distribution, publication, modification, or resale of the product without the express consent of the seller is prohibited and may be considered copyright infringement.
The product is not intended for further commercial use without the seller’s written permission.
9. Prohibited Conduct
The user must not use the service for illegal, fraudulent, or harmful purposes. The following is prohibited:
- circumventing technical limitations of the service,
- attempting automated downloads or manipulation,
- uploading or spreading malicious code,
- disrupting the service’s functionality.
If a breach of these rules is detected, the seller reserves the right to restrict or terminate access to the service and, where appropriate, to take legal action.
10. Errors and Technical Inaccuracies
The seller reserves the right to correct any errors or inaccuracies in the service description, prices, or other information at any time. A price correction does not apply to orders that have already been paid.
11. Temporary Unavailability of the Service
The service may be temporarily unavailable due to technical maintenance or outages. The seller is not liable for any loss or harm arising for these reasons.
12. Personal Data Protection
Personal data is processed in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation, GDPR) and other applicable legislation (e.g., CAN-SPAM, CCPA).
Personal data (in particular email addresses) is stored only for as long as necessary to process the order and to comply with legal obligations; data used for sending the newsletter is stored until consent is withdrawn. The newsletter is sent via Mailchimp. Details, including specific retention periods, can be found in the Privacy Policy.
13. Changes to Terms and Conditions
The seller may change these terms and conditions. The new version takes effect upon publication on the website https://elisgrid.com and applies only to orders placed after its publication; contracts concluded earlier are governed by the version in effect at the time of the order. Newsletter subscribers will be notified of material changes by email.
